Legal Question in Personal Injury in Massachusetts

I brought a lawsuit against a hospital and lost. My lawyer is charging me for a depostion the defense took of me, my wife and mother inlaw. I understand paying for the deposition of the defense , why is he charging me for them deposing me? Also he is trying to charge me for his office photocopying papers, wouldn't that come under his cost of doing business and not an expense to his client?

Your attorney charged you for his time and the cost of the case, I assume. The deposition took time and your attorney probably needed a copy of your deposition.

Did you ever ask him? Probably your fee agreement says you are to pay for out of pocket expenses incurred, such as court reporter's transcript charges. It makes no difference who the deponents are - - you, the defendant, the man on the moon - - these are out of pocket expenses that you typically would have agreed to pay. Perhaps your fee agreement says you only have to pay for transcript charges incurred on depositions that your attorney initiates, in that case then you are right. I've never seen such a clause. It does not matter whether the transcript charges are by choice or by necessity, in all likelihood. I would hate to have a client like you nit picking and going behind my back and trying to get free advice on the internet instead of trying to clear up some mistaken notion that would not exist if he had only read the fee agreement.
