Legal Question in Personal Injury in Massachusetts

Lawsuite Damages

In 1998 my daughter was 14, her patella was dislacated also has a torn meniscus.This happened the 2nd week of school.

She missed 36 days of school that year.The school was furnihed a Dr.s note for every abscence.The abscences were all for her knee.In May of that year the vice princaple took her to court for ''unexcused abscences and truency''

This involved My husband and I Atty. fees, also it was very humiliating for our daughter to have been brought in on such bogus charges. The judge was very upset at the Vice princaple for punnishing this girl who had such an injury.

It was dissmissed.We enrolled our daughter in a private scool after this. My question is , Can we include this situation in the damage amount in the law suit? Lawyers fees, humiliation,Schooling fees for 3 yrs. after. Had she not had the injury this would have not all taken place.
