Legal Question in Personal Injury in Massachusetts

Hi, my question is this, i live in a no fault state {ma} and i was rear ended in nh {not a no fault state} we were injured badly...........who pays? isnt the person who rear ends you the person at fault? we were at a dead stop.

Katrina,

New Hampshire law will control. The party that rear ended you is clearly at fault and their insurance will be responsible. If they have an inadequate amount of insurance or no insurance, you may be able to assert an uninsured motorist claim under your own policy.I have been handling these types of case for over 30 years and practice law in both New Hampshire and Massachusetts. I agree: it is a New Hampshire case, and you will probably need a NH attorney to assist you . NH does not have mandatory auto insurance. Also let your insurer know.

Your no fault insurer will pay your medical bills, then that insurer will obtain reimbursement from at fault motorist or his insurer. If you have medical insurance, no fault will only pay first 2,000 in bills. No fault will also reimburse you 75 percent of your lost wages, again it will recoup from at fault motorist. If you have pain and suffering damages you can bring a claim against the at fault motorist. Most people would retain counsel to do this. Good luck. Regards, JBS
