does a charity have to get patd if thereis no money left.

No. But the Attorney General will be the one to tell you whether there is money left. You need to notify the AG anytime there is a bequest in a will to a charity. You need to keep the AG informed with Inventories and all accounts, including the final account, and you cannot close the estate until the AG signs off.
