Legal Question in Wills and Trusts in Massachusetts

My father passed away without a will. My mom and brother both passed away and I am the only heir. I am trying to have the title of dad's car put in my name, but he lived in PA and I live in MA. MA requires a power of attorney...which we do not have. I do not know how to proceed. My guess is I would need to be named executor, but I have no idea how to get that started either.

If you father lived in PA then you will need to probate the estate in PA. While I am a MA attorney, not a PA attorney, I can tell you generally that most states have a less formal probate process for small estates (usually estates under a certain value). They also have a straight-forward process for people who die without a will (known as "intestate"). I believe in PA you will want to start with the "Orphans Court" in the county where your father lived. You may be able to fill out some forms and do everything by mail. However, my recommendation would be to contact a competent local attorney in that county. A reputable attorney will handle a small matter like yours for a modest fee and save you some headaches trying to figure out the probate rules. Good luck.
