Legal Question in Health Care Law in Michigan

Hello, I am a 24 year old female. My father is currently dying of stage 4 cancer, he has a hiztory of schizophrenia and due to that his 84 year old mother is his guardian. Long story short, my fathers guardian is not fit to make decisions (But she thinks she is) and my brothers and I would like the right to make important choices for our dad when his illness sees him in in final days (Such as making him a DNR, not full code, cremation of the body, ect)What right do we have, if any?

Actually you have no right to make his personal decisions. His mother who is the legal guardian has the right to make his care, custody, treatment, placement, day to day care and usually end of life decisions. If you feel she is not actin in his best interests then you can petition the court to modify the guardianship. You will have to prove that she is not acting in your father's best interest.

We can help you with this process. Info about us can be found at brmmlaw.com or email me at [email protected]
