terminating a contract

I had a contract with an employer and I was suppose to receive a bonus after october 27, 2006 and another bonus on December 15, 2006. The contract states that if the employer terminates the contract after October 27, 2006 that I would be given two weeks notice or pay in lieu of the two week notice and both bonus payments. The manager I was working for never contacted me on or before October 27 and no one from the company contacted me until October 30, 2006. Now the company is telling me that they terminated me on October 27, 2006 and that I will only be able to collect one bonus.

Is the contract in writing? Was the termination in writing? How much money are you talking about? These are all important questions relating to your success. If the contract was in writing it will be much easier for you or an attorney to represent your position. However, if it is not you may still have a valid position.

Figure out he amount of the additional bonus and or pay due to you. Send a demand letter to your employer demanding payment and giving your employer drop dead date to pay. Depending on the amount due and owing you may need to file a complaint in district or circuit court including counts for breach of contract, unjust enrichment, conversion, misrepresentation, and maybe a couple of other claims. Do not sit on this. The secret in resolving these matters is to take them head on and resolve the conflict.
