Why is my husband being garnished now?

12 years ago, my husband received a letter from the district court informing him that he was to be garnished for a medical bill. We heard nothing further, and no money was garnished from his paychecks. These past two years, however, the state has withheld our refund to offset this judgement (we always owed a small amount to the state in prior years). Is it unusual that only the tax refund would be garnished as payment, and why after all of these years has action been taken? Should we be concerned that wages will be garnished?

I would guess that it was an income tax garnishment which was renewed each year by the judgment holder. They can also issue wage garnishments, but that is a separate form and process. Visit kliszlaw.com to discuss further. Tim Klisz
