Legal Question in Credit and Debt Law in Michigan

Am I legally obligated to pay a credit card from over 10 years ago. If the last time I had any correspondence from the company was over 8/30/2004. It is now 2/12/2014 and it has never been on any credit reports

The Statute of Limitations is 6 years for breach of contract, which would involve credit cards. The issue becomes the last time you confirmed the debt (via telephone or correspondence) or made a payment.

That being said they can sue, but you have to raise the statute of limitations defense timely. If the matter defaults, then they can proceed with a judgment against you.

Yes, are you being sued? That is the key. If they sued you years ago and got a judgment, they can collect on it for up yo 10 years before renewing the judgment.
