Legal Question in Criminal Law in Michigan

During a heated argument with my husband almost a month ago, he called the police claiming I hit him (he was quite drunk, I wasn't). While arguing he was pointing his finger 3 inches away from my face yelling at me to shut up. I swatted his hand away from my face and he called the police. He made false statements that I slapped him in the face. There was no marks on him whatsoever. I was arrested and charged with domestic violence. It was during a holiday weekend and I spent 4 1/2 days in jail. I'm not allowed back to MY home and have been slapped with a no contact order. I've been granted a public defender by the judge due to my low income. I know he did it out of revenge and spite because he knows I want a divorce. I feel I'm guilty until proven innocent. I can't believe he can get away with this! What am I facing against? What are my chances of this being dismissed when I go to court this Thursday? I've never been in trouble with the law in my entire 46 years of life! I live in Michigan.

Neil O'Brien Eaton County Special Assistant Prosecuting Attorney

You should be asking your court-appointed attorney all of these questions, not attorneys on an internet Ask the Lawyer site who (a) don't know all the case facts, (b) don't have the police report, (c) don't know what you're specifically charged with, (d) don't know what hearing you're having this Thursday (i.e., an arraignment, a pre-trial conference, a trial), (e) don't know where your case is (because knowing which prosecutor's office is involved or which judge has the case may dictate defense strategy), etc.
