Legal Question in Criminal Law in Michigan

Need help/Opinion

If a piece of physical evidence is going to be used agaisnt a defendent in a murder trial (Hypothetically speaking a coat that was tested and it was found to have gun residue on it.) and the Attorney had information that a Police officer physically wore the evidence (coat)''before'' it was tested does this constitute ineffective assistance of consel. Note This evidence.

Second question is

The coat was ''never'' described at the crime scene and it was taken 44 days after this crime suppose to happen.

Common sense must be telling you that any evidence confiscated 44 days after a crime is suspect. Has this case gone to trial? I need more info to help you. Feel free to call my office Monday the 9th.
