Legal Question in Criminal Law in Michigan

Jared Austin answered the question regarding the vandalism in the parking lot. I did file a police report She has now admitted to the detective she damaged the car...My question was even though she has offered to pay directly to the auto body shop the damage fees I wanna know what a prosecution entails. I believe she needs to be prosecuted.

If the prosecutor believes that charges are warranted he will file charges. It will then be up to the prosecutor to offer the defendant some type of plea offer which depends on a lot of factors. It would probably be a misdemeanor based on what you described. If she accepts a plea offer, her sentence could include anything from fines/costs, probation, or jail or any combination thereof. If she doesn't want to accept any type of plea, the case will proceed to trial and the burden is on the prosecutor to prove that she vandalized your car beyond a reasonable doubt.
