Legal Question in Criminal Law in Michigan

A few questions....

3 Years ago, me and some friends were driving home. I was 16 as well as one of the other friends. The other two friends were 13 at the time. Anyway, we passed by a local paint ball field and the two 13 year olds wanted to stop and look around. Me and the other 16 year old didnt want go go onto their property so we stayed in the car and drove around. Soon they came back with bags of stuff that they had stolen. They had broken into the building and taken about 500 dollars in stuff. The other 16 year old, who is now 19, was recently arrested, I currently do not have an arrest warrant out for my name. The guy who was arrested was charged with B&E w/ intent, larceny in a building, and larceny greater that 2,000 but less that 20k. I am just wondering what kind of sentence could come from that, even though we had no part in actually breaking/entering or even stealing the stuff in general. The warrant was issued because one of the 13 year olds came forward and said that he took the stuff. As far as I know, my name has yet to become involved. Any chances of the case being dismissed before my name becomes involved? What could I face? Charged as an adult though I was a minor when it happened? Any help would be greatly appreciated.

Re: A few questions....

You have WAY to many questions to answer accurately. There are far too many factors to consider before giving you a proper answer. NEVER speak to the police without a lawyer present. You and your friends should all have attorneys.

Re: A few questions....

Don't worry about it until you are charged, if you are even charged. You could be charged as an accessory to the crime, if the prosecutor feels there is enough evidence against you. The police would likely talk to you first as part of the investigation, and if you cooperate as an eyewitness, may not even press charges.

How you are charged and what sentence you could face is based on several facts, including any other criminal charges you've had since then, so your question cannot be answered with definitiveness.

Thanks.

I have a client right now charged with receiving and concealing stolen property even though he was the driver only. If you get police contact, tell them nothing and obtain counsel immediately. If the case is in SE Michigan, contact me at www.kliszlaw.com. Tim Klisz
