Legal Question in DUI Law in Michigan

Hi, should I retain a lawyer because I got a MIP ticket while on probation for possession of marijuana. My probation is supposed to finished in 2-3 months. I was not drinking but was carrying a can of beer around while tailgating at a UM football game in Ann Arbor. What normally happens? Should I call my probation officer today or the lawyer?

You definitely need to retain a lawyer because you ar fighting a two-front battle: the MIP charge and the probation violation. More than likely you violated k ore than one provision of your probation. Normally you cannot consume alcohol while on probation (you can't anyway because it's illegal for you), you cannot be in the presence where alcohol is being consumed, and you can't violate any law. Make sure you inform your PO right away because you have to report any official police contact within 24 hours. If not, that is another violation. You are facing jail time and the possibility of having your probation revoked. If that happens, you can be sentenced up to the maximum amount co the marijuana charge.

I would start searching for an experienced criminal defense attorney from your area ASAP. Good luck.
