Legal Question in Family Law in Michigan

My 14 year old nephews father just passed away on 5/24/14 and was living with his father and his grandmother. My sister whom is my nephews mother wants him back although the judge has denied her 3 times in less than a year and twice just this month. My nephew would rather stay with his grandmother and we are wondering if he can legally stay in some way because my sister is not his best option?????

They can apply for guardianship through the probate court.

The answer depends on several factors. First factor is why the judge denied your sister custody of her son. Second factor is to determine what kind of case the judge's order was made. In other words, was it a divorce, a limited guardianship and CPS case, etc.
