Legal Question in Family Law in Michigan

Child support amount ?

My divorce was final Sep 2008. In our jod- I am to pay my ex-wife 2,000.00 / month. I am now having second thoughts and I think its way too much for a one year old. I asked my ex wife if she would agree to a reduction and of course she said no. so I am thinking about hiring a lawyer to get 50/50 custody and that way I wouldnt have to pay this amount. Is this true. Fyi: My ex wife has physical custody with joint legal custody.

Re: Child support amount ?

Child support is determined by various factors, including the division of custody, amount of parenitng time, income of both parties, etc. There is no guarantee that you would be awarded 50/50 custody, however, if there are other factors that would justify a reduction in child support, then you should definitely retain a lawyer to get the process started immediately, as the child support reduction is only retroactive to the date that you request a modification.

I would also have to review your JOD and determine what the current child support award was based upon, and whether it was fair.

If you decide to retain a lawyer, please contact me.

Thanks.
