Legal Question in Family Law in Michigan

My husbands ex wife enters into my house (without knocking, or anything) when dropping the children off here, what action can I take against her to get her to stay off my property!

Also sends threatening texts about how she is going to get full custody of the children, when she gave up her full custody and we have joint physical custody now, What age are children allowed to testify in court with a custody battle?

Good morning,

In Ottaw county the judges are pretty proactive. Here are some of my suggestions.

1. As for her just walking into the house, politely ask her not to any longer(I am sure you have), then if that does not work file a police complaint. You could also seek to amend Judgement of Divorce order, or ask your husband for help through the friend of the court.

2. The text messaging, though annoying, does not seem overboard to this point. If it reaches a harassment level I suggest filing a motion through the court or ask FOC for help.

3. Ottawa court has been reluctant in the past on children testifying. It will consider private in-chambers child/judge only meetings for kids ages 10+.

Please feel free to contact me for a free office/phone consultation if any further information is needed. I would be happy to help. Sometimes consulting an attorney from another county is a plus. Miles J. Murphy, III 616-458-3994
