Legal Question in Family Law in Michigan

Joint Legal Custody- Childrens records

Hubby has 2 daughters, he has joint legal custody and their mother has sole physical. Court order states they are to have equal rights and responsibilities wth regards to the childrens upbringing, health, education etc. Hubby can't get copies of medical or dental records because mom has stipulated that only her and step-dad can and she refuses to sign HIPPA papers allowing their dad (my hubby) access. She has violated many aspects of the courts order and has done so for quite sometime and various subjects. She even kept the children from him for over a year and the FOC didn't step in until a year and a half later, then they just told her what to do and gave her a slap on the wrist. She forces hubby to deal with her hubby regarding the kids and refuses to cooperate whatsoever. She talks ill of their dad to the kids which causes them to be very distant from their dad because of the bad thing's their mother says about him. Tried to get FOC to step in, but they refuse to and we can't afford a lawyer. We're trying to see if he qualifies for legal aid, but we're affraid that with where he works, he will only get turned down. We want full custody because the kids best interest is not being met in the current situation. Any advice PLEASE?

Re: Joint Legal Custody- Childrens records

Custody cases involve the greatest amount of time, energy and diligence of any type of domestic case. To ask a lawyer to undertake this and do a good job, demands a great investment of the lawyers time and energy. Please remember that the lawyer did not create this situation. It is the result of many years of many bad choices. Who pays the penalty? The kids. Therefore, since you are getting no results you should look at what you are doing, what you are requesting and do something that will work. You need aggressive and diligent legal representation. Look at money that you spend. Do you smoke? Give it up? Do you drink? Don't spend $ in bars. Take the money that you would spend elsewhere and invest it in the most important part of your life....the kids. Hire a competent lawyer. William S. Stern
