Yes, the Child Custody Act of 1970 which list the factors that the judge must take into consideration when determining custody. However, the preference of the child is just one of several factors. The law states the reasonable preference of the child is to be taken into consideration and the judge weights the age and maturity of the child when deciding how much weight to give the preference of the child.
