Visitation/Custody changes

My fiance has two children. He currently has only supervised visitation in his ex-wife's home. This is due to the fact that he was not at court for his divorce and that is what she wanted. She told him he did not need to be there. What can we do to change the visitation rights and/or the actual custody? We would at least like normal visitations.

File a Motion to Modify Divorce Re: Supervised Parenting Time. The friend of the court will hear the motion and if denied you should request a Friend of the Court Investigation. The friend of the court can investigate and prepare a recommendation.

Procedures may vary from county to county depending on where the motion is filed.
