Legal Question in Landlord & Tenant Law in Michigan

Storage rental agreements

Can the owner of a self-storage warehouse change the terms of agreement of your rental without notice? Our storage unit company claims that there is no longer a grace period and has doubled the late charge if you payment is just 1 day late. My husband and I are OTR truck drivers and mail our payment to them a week before it is due. They claim that we have late payments. The agreement that I signed states that there is a 7 day grace period and after that the late charge is $5.00. We have not received notice that this has changed. Can they do this?

Re: Storage rental agreements

The contract you have should answer that question. Look for a clause that is called an integration clause and says something about this agreement being the sole agreement between the parties and all other agreements between the parties are null and void. Also another clause in the contract should address modifications of the agreement can be in writing or orally. Even if this clause allows oral modifications, any changed would have to be approved in advance by you before they would become effective.
