How Much Can I Sue For?

On Christmas Eve I was hit by another driver. He was in the wrong lane and turned into oncoming traffic. I only have no fault insurance and the other driver has full coverage, but he has not filed a claim with his Insurance Agency. I was told that the insurance agency could not fulfill my request for the minitort claim until the other driver filed a claim with them(he was ticketed and I turned the police report information to his agency). Can I sue him personally and for how much. I feel I am entitled to more than $500. This has put so much stress on me and I don't think it's fair that he can walk away from this without paying for it.

There is no way an attorney can tell you how much you can sue for without more detail. However, you might consider having an attorney negotiate a settlement for you for a small flat fee, rather than trying to litigate this claim if there were no serious injuries. Sure, it is stressful, but from what you've written there is not the sort of large claim that would justify litigation. This opinion might change depending upon what your actual damages are, however. If your actual damages are only $500, then you would probably be better off negotiating a settlement, even if it takes a little longer working through the insurance company.
