Legal Question in Traffic Law in Michigan

Seat Belt Ticket

Due to my size and being overweight most passeneger side vehicle seat belts do not fit me, and it is difficult to get in and ride in the back for long distances. I recently moved to MI, though have been resident before, and traveling today was pulled over under the ''click it or ticket'' for not wearing seat belt in front passenger seat. I am physically unable to wear seat belt and as I said I just moved and I am currently unemployed, as I have not been able to find work. I have no income and am living with family facing a $65 fine. What options do I have in this situation?

Re: Seat Belt Ticket

Being overweight is not an exception written into the law. Certainly someone sells seat belt extensions.

Re: Seat Belt Ticket

You might be successful if you fought the ticket in court, but they'd also be concerned for your safety. I would expect they would only dismiss it if you had a seatbelt extender installed. Unfortunately there is no exception in the law and thus the court would only grant you leeway if you did something to show you'd no longer break the law, i.e., installing an extender.

Good luck.

Thanks.
