Custody

If a parent were to petition the court to change custody, is there an allotment of time the child must spend with the custodial parent? Someone said that a child must spend the equivalent of 6 months with the custodial parent. Is this true?

In order to claim a dependency exemption on your income taxes, you must either have the child more than half the year or you must have the other party's permission (or a Court Order) granting you the tax exemption.

In Minnesota, there is no specific allotment of time that a child must spend with either parent. However, there are some specific rules regarding motions to change custody.

There is no specific amount of time that a child must be in the care of a non-custodial parent in order to file for a change of custody. However, there are specific rules that must be followed to get the court to reopen a previous custody determination. We offer a free initial consultation.
