Legal Question in Criminal Law in Minnesota

misdemeanor theft

I have a misdemeanor theft summons with a court date of 3.19.08. MN state statute 609.52. I had taken merchandise valued at $7.50 and was caught. I have no other misdemeanors, except petty misdemeanors (all fines paid and taken care of). Under statute 609.52 section 3 I face possible fines of $1000 and/or 90 days in jail. What can I expect as a sentence and is there any way to keep this off my record?

Re: misdemeanor theft

With the assistance of an attorney, often any conviction may be avoided with an agreement to Stay Prosecution. If there are no same or similar offenses within a defined period, the charges are dismissed. I would not advise pleading to the charge since a conviction can have a long lasting impact on employment and even renting an apartment.
