Legal Question in Criminal Law in Minnesota

In state of MN a police officer seized my car from my fiance. He seized it claiming it as evidence in a fraudulent check case. The car has already been bought and paid for and is just a mode of transportation. I only received the seized paper and no other forms. I have tried calling public defender office that is handling the case. No response. Can't talk to police department. How do I go about getting my car back?

The Public Defender cannot help you. You have to file the claim to preserve your rights to argue about the seizure. The notice you have tells you that you have a short period of time to file and, most likely tells you that if the vehicle is under a certain value you can file in conciliation court. The fees are less and the procedure is shorter. You may be able to get the vehicle to use in the short term by trading the title. Contact the county attorney in the county where the vehicle was seized to discuss that. If you do not file you lose the right to argue about the car.
