Legal Question in Family Law in Minnesota

My brother is from MN and has limited visitation of his son in Mississippi. While visiting his child, he was informed that his ex has been in rehab three times. He found supporting paperwork, and is hoping to get custody. Is this something that would hold up in court?

Chemical abuse is only one of thirteen factors that courts use to determine custody. So with only this information, it's impossible to say what a court would do. He really needs to consult with an attorney if he is looking to modify custody.
