Your post is not clear - 'your daughter' - 'her moms' ?? I suggest you pay to confer privately with an experienced family law attorney and she ought to be able to provide you with detailed legal advice and counsel in light of the full facts.

Your pot is somewhat confusing. Why Is your daughter i a shelter. Certainly, you can file a Motion to change custody and, as part of that proceeding, seek an ex parte order seeking immediate custody pending a resolution of the proceedings. Such matters, however, are not simple and you should have experienced counsel. I can be reached at 612-240-8005.
