Legal Question in Family Law in Minnesota

I am disabled from effects of tbi and ssdi expedited due to dire need and found errors of previous legal rep. I cannot work. My 2 children lived with my brother for the school year and received all MFIP benefits without my brother's or his wife's income used against them. Now home, I am told their step-dad's income is going to be used against them, but he has no custodial or legal rights to my children. They have a legal father by ROP and he should be pursued for child support. My husband were in a legally recognized domestic partnership for 11 months before marrying and he has never been applicant, just a household member, and his income was used against me when we got married, which I am fighting. Can they deny me or my children based on my husbands (their step-dad) income while I wait for my SSDI? My needs and my children's needs didn't change because I got married. HELP!
