Legal Question in Family Law in Minnesota

My husband and I signed a post nuptial agreement, which stipulates certain financial responsibilities during our marriage,his ex wife is now seeking to increase their child support,, can our financial agreement in our post nuptial be use to combat this child support modification?

First, post nuptial agreements are difficult to enforce, they must be executed with great clarity and each party must be represented by an attorney. They are not favored under Minnesota law.

Second, your post nuptial agreement would have minimal, if any impact on a pre-existing child support obligation from a prior relationship. It is deemed to have been entered into with full knowledge of the pre-existing obligation.
