Legal Question in Family Law in Minnesota

Spousal rights to pension income

My step-father has been diagnosed with alzheimers. Without my mothers knowledge he signed a document giving his son power of attorney. The son has now directed his social security and pension checks be sent to him. He keeps the money and sends my step-father only $1600/month. What rights does my mother have to his ss and pension income?

Re: Spousal rights to pension income

There are additional facts that are necessary to answer this. This may be a situation that calls for the appointment of a conservator for the step-father together with an order regarding support for your mother. It also may be a basis for divorce with similar issues. Your mother needs to seek legal advice.
