For FMLA purposes, it counts employees based upon the number within 75 miles of the worksite at which the employee requesting leave provides services. In this case, under the federal law, you could not count the employees in Las Vegas or San Diego. State law may provide a different answer. Therefore, you should consult with an attorney in your state to determine what rights you may have.
