Legal Question in Civil Litigation in Minnesota

Owed Money

I loaned someone $3,000. It was credited to one of my unused credit cards. The agreement was for her to make the regular payments until the card was paid off. She did for awhile, but then started to accumulate late charges. The bill is now up to $3,600. So to protect my credit and make it easier for her to make payment we agreed I would make the payment so it was paid on time and she would reemburise me by the end of that month. I have seen no money for the last 3 months. I have a witness to the aggrement that was made and her cancled checks prove she was making payments. Can I take her to court to get my money back and do I need a lawyer?

Re: Owed Money

It isn't clear that all the legal formalities for formalizing the debt have been met, but based on her partial performance of the agreement you may be able to prove it up in court.

You don't need a lawyer for this. You can use the Conciliation Court in your county for claims up to $7500. In most cases parties represent themselves and don't bring lawyers.

In Hennepin County, the conciliation court is located at Room 306 City Hall. Phone # is 612.348.2602. They can help you get started.
