Legal Question in Immigration Law in Minnesota

My fiance is from El Salvador. We have a three month old baby together. I am financially dependent on him- he works, I stay home with our baby and go to school part time. He entered illegally over a year ago. When we are married what can we do to get him a greencard? Would he have to go back to El Salvador? If he does I will not be able to provide for myself or my son and moving to El Salvador is out of the question because I am currently in college and the crime and violence is horrific.

After you are married you can file an I-130 Petition for Alien Relative on his behalf. However, because he entered illegally he would have to return to El Salvador.
