Legal Question in Intellectual Property in Minnesota

Is this website copyright infringement?

I am doing a website allowing people to search for food from restaurants, along with the price. My database will consist of information from their online menus, but I will not be using their menus on my site -- I will be putting the info into a database which someone can then search.

Say you want a pepperoni pizza. Click on pepperoni pizza, type in your zip, and up pops the 3 closest spots to get it along with the price.

It seems to me this will be OK since I'm essentially giving them free advertising, but I don't want to get in trouble!

If it benefits the restaurants in question, why not just get their permission?

Otherwise, depending on what and how you use it, you can be breaching their TM's and other intellectual property.
