Legal Question in Employment Law in Minnesota

Job description for congregation administrator

Can our job description for a '' congregation administrator'' include under qualifications that the person should be ''active in a Christian congregation.''

We don't want to wrongfully discriminate against anyone, but the primary purpose of the position is to help the congregation carry out its vision of ''Passing on faith in Jesus Christ, and helping people grow in living out their discipleship.''

The law allows for legal discrimination where a certain characteristic (like religion) is a BFOQ ( Bona Fide Occupational Qualification).

So yes, you may certainly make that a requirement of the position.

Call or email if you would like a more formal legal opinion.
