Legal Question in Real Estate Law in Minnesota

we have land with a billboard on it...want to create an easement from the road to the sign and either sell or donate the land. Is this possible? What is the procedure? thank you. Also we have a parcel of land that has gone forfeit as a result of a clerical error on the part of our attorney. Back taxes etc. 200000 we never knew we had parcel...if we let it go any repurcussions on our personal credit lines...it is owned by a partnership...three sisters. thanks.

I need more information to answer your questions. It is possible to create an easement, but I can't tell on these facts if the easement is feasible. On the back taxes part, letting the land go may or may not affect your personal credit; I would need more information to give you a definitive answer.

Typically you would agree with the sign lessee as to the location of the access easement and then have a surveyor come up with a sufficient legal description of the easement, which would then be turned into a written document by your attorney. As to the back taxes, I would certainly investigate whether you can reacquire the land. There are some limited rights to do so. Have you talked to the attorney in question to see if he or she can do anything to remedy the situation?
