Legal Question in Real Estate Law in Minnesota

property and divorce

I have owned a home from before I married my wife and she was never added to the title. We are getting divorce and I was wondering if she would be able to take my house?

Re: property and divorce

There will be a marital and non-marital component to the homestead equity, based on a formula that is called teh Schmitz formula. It does not matter how the home is titled What is important is the equity that was created during the marriage.

you may review an article on the Schmitz formula at http://www.divorceprofessionals.com
