Legal Question in Real Estate Law in Minnesota

property owners' easement rights

Our electric co. is stating that they have the right to cut down 5 of our trees because they interfere with the power lines. In the past they have trimmed them down, but now they say they can't keep up with it. There is an easement where the lines are, but does that give them the right to cut down all of our trees. Please help, I don't want to lose our trees, but it could be a matter of days, they have already cut down our neighbors. Thank you

Re: property owners' easement rights

You would have to sue the power company and get an injunction, a very difficult and expensive thing to do, which might only delay the cutting of the trees. Your best bet is probably to kiss those trees goodbye.

Exactly what your rights are would be determined by the language in the easement. To explore it more fully, get a copy of it and go to a lawyer for a consultation.
