Legal Question in Real Estate Law in Minnesota

Our roof should be repaired

We own our home and have an association that takes care of the outer structure. A few years back the association had our roof repaired, the contractor they choose didn't do a good job and now our roof is in need of replacement, they called the contractor and they happen to be out of business, now the association wants us to have it fixed at our expense, do we have to or do they have to have it done since they hired the contractor themselves, the association manual states that the replacement and repair of the roof is their responsibility, they feel because they already replaced it that now we should pay, we didn't choose the contractor and I feel we shouldn't have to replace it now that it's damaged. What is my legal obligation?

Re: Our roof should be repaired

This is a more involved question than you may think. The association documents usually govern. There is also a contractor's recovery fund, though, that you should look at and talk to your association, and its attorney, about.

MY STANDARD DISCLAIMER: This is not intended to be legal advice or to create an attorney-client relationship. No attorney-client relationship is intended until you and I sign a retainer agreement.
