Legal Question in Criminal Law in Mississippi

My elderly mother gave her credit card # to her younger sister so that she can rent a car. My mother has found many additional charges on her credit card account that her sister charged. She did not have permission to charge anything else but the car rental. Also, the car rental was returned late with damages. The Car rental company is now charging those damages to my mother's credit card. Is it possible to have charges pressed for credit card fraud even though my mother gave her the card number?

Yes, for the unauthorized charges she could be arrested and charged with a felony of "Credit Card Fraud" and if convicted she would likely be sentenced to a term in prison (which may or may not be suspended and if suspended, may be suspended in whole or in part) and restitution for all monetary losses. It is suggested that without threatening the criminal prosecution you simply go to the sister and demand reimbursement of all unauthorized charges and allow her the opportunity to do what is right without involvement of law enforcement. If she refuses simply contact the local County Attorney or a representative of the local District Attorney's office and advise them of the facts.
