Re: Extradition

No. I am not aware of any time limit and, to my knowledge, no such time limit is provided in the Mississippi Code. Additionally, depending upon the circumstances of an individual's arrest and/or crimes charged in either Mississippi and/or Missouri, they may or may not be entitled to bail. In Mississippi, an individual is generally not entitled to bail while pending extradition to another state (e.g., Missouri) if the other state has caused a warrant of rendition or extradition to be issued in Mississippi. So, in the case you asked about, if the State of Missouri has caused such a warrant to be issued in Mississippi, the individual in custody will be held without bail pending extradition. The remedy for one being held (too long, without cause, etc.) for extradition is to seek habeas corpus and a lawyer is needed to accomplish this task.
