Legal Question in Criminal Law in Mississippi

In the State of Mississippi can you get resentenced if the law has changed and you were sentenced by far more time than you would have got on the same charge now? For instance... sentenced to serve 34 years with enhancement. Now with new law max is 8 years or 16 with enhancement.

In some cases, yes. There was a case recently where a defendant was sentenced to serve twenty (20) years and he violated terms of probation. At the probation revocation hearing he was able to obtain a shortened sentence, down to eight (8) years. As a result he is eligible for release in January 2015 in lieu of August 2022
