If someone has a warrent for their arrest for drugs and the sentence is 5 years can they go to rehab instead of going to jail?

Not as a matter of right. However, competent and creative counsel may be able to fashion a sentence where the defendant is sentenced to serve time which is suspended based upon attendance at and completion of an in - house treatment and upon conclusion of a long term treatment program he could be released on probation.
