double charge

I was charged on a uniform traffic ticket for two charges; under the influence, speeding, and having bac greater that .08 (.083). Can I be charged with both on one ticket?

Re: double charge

You can be charged with both. However, they are both considered to be driving under the influence and are essentially multiplicious charges for the same offense. You will be found guilty of one offense if either or both are proved by the prosecution.
