Legal Question in Family Law in Mississippi

I have taken care of three of my grand all their lives with the exception of the almost two years they lived in Elpaso,Tx with their mom. During that time the oldest that was about six years old at the time was the mother to the two youngest that was around two and four years old ,they live in shelters and anywhere the mother decided to leave them. The mother( my daughter) was finally locked up for child abandonment in 2008 my son and I had to make a mad dash there to get them. They have been with me ever since. Since school have been out and she has a new man in her life she lives with and they mistreat them and the girls say they are uncomfortable around her man but she won't listen. They don,t want to be there and they constantly ask to come back with me but they get cursed and called all kinds of names and constantly threatened . My question is how old do kids have to be before they can decide who they want to live with????

There is no magic age at which a child's desire is law. The test is in the best interest of the children. The larger question is who has legal custody now? What is the visitation? You need to answer these questions and see what legal steps need to be taken to go forward
