Equity

My husband been living in the property 3 years before I moved in 2 years ago. How much equity could I obtain?

The court has a number of tool to place the divorcing couple in essentially equal position after the divorce. A spouse's interest in non-marital property is dependent on whether that spouse made some sort of contribution towards its purchase. Also, it may be affected by the property being located in a community property state or if the property was purchased whiled the purchaser was a domicilary of a community property state. Additionally, the court can create an equitable trust for contributions towards its improvements. Lastly, the court can create an equitable trust as lump sum alimony just to balance out the other equities.
