Guardianship

my step-father and my mother have guardianship of my 12 yr old. since 2005,my papers state that I still have legal cusody of the minor child.would i need to go back to court to get her back in my care or can i just go get her being they only have guardianship.my daughter has told me she wants to be back with me now thats i'm stable to care for her. thank you for taking the time to reply,and i hope you can answer my question...thank ou,stacey

I am guessing your papers that say you have legal custody came before the guardianship was established. Based on that assumption, you will need to go back to court. I suggest you speak to your mother and step-father about this and see if they are willing go along with your child�s request. If everyone is in agreement, this can be rather inexpensive and not such a traumatic and emotional experience for all involved. I also recommend you seek advice from a local family law attorney in your area.
