Legal Question in Family Law in Mississippi

Non-payment alimony

If I file contempt charges against my ex-husband, do I have to use an attorney? If I use an attorney, can I get back my attorney fees, travel costs, etc.

Re: Non-payment alimony

You could represent yourself if you wish, but I would not recommend it. Anyway, if he is clearly in contempt, and you have clean hands (not in contempt yourself), you would almost certainly be awarded your attorney fees. I find it is usually the attorney fees that teach the person in contempt a valuable lesson. They generally know they cant get away with not paying their alimony or child support, but they feel like they can delay and make it up later without any penalty. When they get hit with the attorney fees and court cost, in addition to what they owe, they will think twice about letting it happen again.
