Legal Question in Family Law in Mississippi

My uncle has sole custody in ms, but my daughter lives with her father in tn which means he has physical custody over our daughter. My uncle has agreed through text messaging that I have proof of that my daughters father and I can figure out visitation and plans with our daughter but refuses to release custody. My daughters father agreed to let her stay for summer and go to school this year, what if he or my uncle changes their mind last min? Do I have to return her immediately even if she is already enrolled in school? Can I be charged with parental kidnapping if I continue on with school here In the state in which she originally lived in before I signed sole custody over to my uncle? How can I prevent charges or go about all of this?

If your uncle has custody in Mississippi by a court order then that order must be modified in Mississippi or in what ever state the court ordered custody resides
